毒物及び劇物の管理等に関する指導について/Guidance on the Management of Poisonous and Deleterious Substances

 8月27日に理学部建物において発生した事案を受け、同28日に行われた札幌市の立ち入り検査の結果、9月2日付けで札幌市保健福祉局医務・保健衛生担当局長名の指導書を受け取りました。

 指導の内容は、本事案が発生した研究室において、毒物及び劇物の盗難・紛失・漏洩等の措置を定めた毒物及び劇物取締法第11条及び毒物及び劇物の表示を定めた同法第12条※1に違反する不適合事項※2が確認されたということで、①当該研究室における不適合事項の速やかな改善、②全学的な法令遵守管理体制の徹底、③事故状況及び改善結果の報告を求めるものとなっております。

 本学としては、本件を極めて重大な問題であると認識しており、指導内容を厳粛に受け止めております。指摘を受けた事項については、関係行政機関等と連携のうえ、速やかに必要な改善措置を講じるとともに、全学的な管理体制の見直し及び再発防止策の徹底を図り、関係法令の遵守と安全管理の徹底に万全を期してまいります。

※2(1)毒物及び劇物専用保管庫における他試薬の混在
毒物及び劇物を貯蔵する専用保管庫内に、毒物又は劇物に該当しないその他の試薬が混在して保管されていたこと。

(2)毒物(フッ化水素酸)の受払・管理帳簿の未整備
フッ化水素酸の管理帳簿が所在不明となっていること。

(3)保管庫の鍵管理の不備
保管庫の鍵の出納管理を行う管理簿が存在せず、学生等が自由に鍵を出し入れできる状態にあり、施錠管理が形骸化していたこと。

(4)小分け容器における表示の欠如
毒物又は劇物を小分けして使用している容器において、「医薬用外毒物」等の必要な表示等の記載がなされていなかったこと。

  なお、(3)につきまして、当該研究室では本学の学生等であれば誰でも自由に鍵を取り扱うことができる状態であったわけではなく、保管庫が設置された部屋自体も施錠管理されており、当該研究室に所属し、必要な安全教育を受けた上で、管理者が認めた学生に限って鍵の取り扱いを認めていました。しかしながら、このような鍵の管理方法では、法令上求められる管理体制として十分ではなく、不適合事項と判断されたものです。

(English Translation)

Following the incident that occurred in a building of the Faculty of Science on August 27, the City of Sapporo conducted an on-site inspection on August 28. As a result of the inspection, Hokkaido University received a written notice of guidance dated September 2 from the Director General responsible for Medical Affairs and Public Health of the Sapporo City Health & Welfare Bureau.

The notice stated that instances of non-compliance had been identified*1 in the laboratory to which the incident occurred. These instances involved Article 11 of the Poisonous and Deleterious Substances Control Act, which stipulates measures to prevent the theft, loss, leakage, and other incidents involving poisonous and deleterious substances, and Article 12 of the same Act, which stipulates labeling requirements for such substances*2.

The University was instructed to: (1) promptly rectify the instances of non-compliance in the laboratory concerned; (2) ensure thorough university-wide compliance with relevant laws and regulations and strengthen the associated management system; and (3) report on the circumstances of the accident and the results of the corrective measures taken.

Hokkaido University recognizes this as an extremely serious matter and takes the guidance with the utmost seriousness. In cooperation with the relevant administrative authorities and other organizations, the University will promptly take the necessary corrective measures in response to the issues identified. We will also review our university-wide management system, thoroughly implement measures to prevent recurrence, and make every effort to ensure full compliance with relevant laws and regulations and rigorous safety management.

*1 The instances of non-compliance
(1) Storage of other reagents together with poisonous and deleterious substances in a dedicated storage cabinet
Reagents that did not fall under the category of poisonous or deleterious substances were stored together with poisonous and deleterious substances in a storage cabinet designated exclusively for such substances.

(2) Inadequate records for the receipt, dispensing, and management of a poisonous substance (hydrofluoric acid)
The management log for hydrofluoric acid could not be located

(3) Inadequate management of the storage cabinet key
There was no log for recording the issuance and return of the storage cabinet key, and students and others were able to take and return the key freely. As a result, the key-control system had effectively ceased to function as intended.

(4) Missing labels on containers used for subdivided quantities
Containers into which poisonous or deleterious substances had been subdivided for use did not bear the required labels, such as "Poisonous Substance for Non-Medicinal Use."

With regard to item (3), in the laboratory concerned, it was not the case that any Hokkaido University student or other member of the University community could freely access or use the key. The room in which the storage cabinet was located was itself kept locked, and only students belonging to the laboratory who had received the necessary safety training and had been authorized by the person responsible were permitted to handle the key. Nevertheless, this method of key management was deemed insufficient to meet the management requirements under the relevant laws and regulations and was therefore identified as an instance of non-compliance.
